Terms of Service

1. Service Description
CallProxy provides AI-powered phone call screening for residents of the United States. We assign you a Twilio-provisioned virtual phone number; calls to that number are answered by an AI assistant that you direct in real time through your account dashboard.
We are not a phone carrier, an emergency service provider, or a recording service. CallProxy is not a substitute for 911 or any equivalent emergency service.
2. Eligibility
You must be at least 18 years old to use CallProxy.
You must be physically located in the United States. CallProxy is not offered to users outside the US, and we may suspend accounts that appear to be operating from outside the country. You may not use a VPN or other technical means to circumvent this geographic restriction.
You may not use CallProxy for any unlawful purpose.
3. Acceptable Use
You may use CallProxy for personal or business call screening. You may NOT use CallProxy:
- To harass, threaten, defraud, or impersonate any person or organization.
- To record any call in a manner that is unlawful in your or the caller's jurisdiction.
- For TCPA-regulated outbound calling, robodialing, telemarketing, autodialed text messaging, or any other regulated outbound communications. CallProxy is an inbound-only service.
- To circumvent any third-party service's terms of service or any geographic restriction.
- For any activity that would be unlawful if performed without CallProxy's involvement.
We may suspend or terminate accounts engaged in any of the above activities without prior notice.
4. AI Disclosure Requirement
You acknowledge and agree that the AI assistant audibly discloses to every caller, at the start of each call, that the caller is speaking with an AI and that the conversation will be transcribed.
You may NOT configure the AI's system instructions, custom greeting, or per-number override to:
- Deny that the caller is speaking with an AI.
- Claim or imply that the AI is a human.
- Suppress or disable the transcription disclosure.
This requirement exists to comply with applicable law, including the FTC Act's prohibition on deceptive practices and US state AI disclosure laws (e.g. California SB 1001 / California BPC § 17941). Violations may result in immediate suspension.
5. Call Transcription and Retention
Audio is processed transiently and is never recorded or persisted. Text transcripts of calls are stored for 90 days from the date of the call, after which they are automatically deleted.
You are responsible for ensuring that transcription of calls is lawful in your state and the caller's state. The AI's spoken disclosure that the conversation will be transcribed is intended to satisfy "all-party consent" / "two-party consent" notification requirements in states that require them, but you should consult your own counsel if you operate in a regulated industry.
6. Payment Terms
Paid plans are billed monthly or annually in advance through Stripe. Pricing and included minutes for each plan are described on our pricing page and at checkout.
New paid subscriptions begin with a 14-day free trial. We will charge the payment method on file at the end of the trial unless you cancel before it ends.
You may cancel at any time. Cancellation takes effect at the end of the current billing period. We do not provide refunds or credits for partial periods, unused minutes, or unused trial days.
Overage minutes (calls beyond your included monthly minutes) are metered and billed at the per-minute rate disclosed for your plan. We reserve the right to suspend service if invoices remain unpaid after 14 days.
7. Limitation of Liability
CALLPROXY IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the service will be uninterrupted or error-free, that AI responses will be accurate or appropriate, or that calls will be screened in any particular way. We are not responsible for missed calls, incorrect AI responses, transcription errors, third-party service outages (Twilio, OpenAI, Stripe, Supabase, Fly.io), or disputes between you and your callers.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THIS AGREEMENT OR THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
8. Termination
You may delete your account at any time from Settings → Profile → Delete account, or by emailing s.takahata.business@gmail.com.
We may suspend or terminate your account, with or without notice, for any breach of these Terms or for fraudulent, abusive, or unlawful activity.
Upon account deletion, we permanently delete your profile, call transcripts, virtual phone numbers, push subscriptions, and notifications within 30 days. Billing records are retained for 7 years as required by US tax law; all personally identifying information in those records is removed.
9. Governing Law and Dispute Resolution
This agreement is governed by the laws of the State of Delaware, without regard to its conflict-of-law principles.
Any dispute arising out of or relating to this agreement or the service must be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will take place in Delaware or, at your election, by remote videoconference.
YOU AND CALLPROXY EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO BRING OR PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING.
If any portion of this dispute-resolution provision is held unenforceable, the remainder remains in effect, except that the class-action waiver is non-severable: if it is held unenforceable, this entire dispute-resolution provision will be void.
10. Changes to These Terms
We may update these terms periodically. For material changes, we will notify you by email and by posting an in-app notice at least 30 days before the changes take effect. Your continued use of CallProxy after the effective date constitutes acceptance of the updated terms. If you do not agree to the updated terms, you must stop using the service and delete your account before the effective date.
